This Warranty Policy applies to products supplied by RESQ Equipment Pty Ltd (ABN 28 669 537 473) trading as RSQ Australia.

This policy should be read together with our Terms & Conditions of Sale and Delivery & Returns Policy.

Nothing in this policy excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

1. Australian Consumer Law

Where the Australian Consumer Law applies, goods supplied by RSQ Australia come with consumer guarantees that cannot be excluded.

Depending on the circumstances, these guarantees include requirements that goods:

  • are of acceptable quality;

  • are fit for any purpose made known to us where the applicable requirements are met;

  • match their description;

  • match any sample or demonstration model where applicable; and

  • satisfy other consumer guarantees imposed by law.

If a product fails to comply with an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and nature of the failure.

These rights apply independently of any manufacturer's warranty.

2. Manufacturer warranties

Many products supplied by RSQ Australia are manufactured by third parties and may include a manufacturer's warranty.

The duration and conditions of a manufacturer's warranty vary between products and manufacturers.

Where manufacturer warranty information is available, it may be:

  • included with the product;

  • stated on the product page;

  • provided in product documentation; or

  • available from RSQ Australia on request.

A manufacturer's warranty is additional to any rights you may have under the Australian Consumer Law.

Where RSQ Australia has obligations as the supplier of a product, the existence of a manufacturer's warranty does not remove those obligations.

3. RSQ Australia manufactured or modified products

Some products may be manufactured, assembled, modified, printed, labelled or otherwise produced by RSQ Australia.

Where a specific written warranty is provided with an RSQ Australia product, the terms and duration of that warranty will be stated with the product, quotation or other documentation.

Where no separate written warranty period is specified, this does not exclude any rights or remedies that may apply under the Australian Consumer Law or other applicable law.

4. Making a warranty claim

If you believe a product has developed a fault or defect, please contact RSQ Australia before returning it.

Where available, please provide:

  • your name or business name;

  • order, invoice or quotation number;

  • product name and model;

  • serial number, where applicable;

  • date of purchase;

  • a description of the problem;

  • details of how and where the product is being used; and

  • photographs or video showing the issue where useful.

Providing this information can help us assess the issue and determine the most appropriate next step.

5. Assessment

Depending on the product and nature of the issue, we may ask you to:

  • provide additional photographs, video or diagnostic information;

  • perform reasonable basic checks;

  • return the product to RSQ Australia;

  • make the product available for inspection;

  • take the product to an authorised service agent; or

  • follow another reasonable assessment process.

We will not require an assessment process that unreasonably prevents you from exercising a right or remedy available under applicable law.

6. Freight and return costs

Please contact us before returning a product for warranty assessment so that appropriate return arrangements can be made.

Where a product is confirmed to have a problem for which RSQ Australia is responsible and you are entitled to a remedy, reasonable return, collection or other associated costs will be dealt with as required by applicable law.

If a product is returned as a warranty claim and assessment establishes that the problem is not covered by a warranty or applicable legal guarantee, we will discuss any proposed repair, freight or other charge with you before undertaking chargeable work.

7. Repairs, replacements and refunds

The appropriate remedy depends on the circumstances, including the nature and seriousness of the failure and your rights under applicable law.

A remedy may include:

  • repair;

  • replacement;

  • refund;

  • supply of a replacement component; or

  • another remedy agreed with you or required by law.

Where a manufacturer's warranty applies, we may assist with arranging the manufacturer's warranty process where appropriate.

Nothing in this policy allows RSQ Australia or a manufacturer to substitute a warranty process for a remedy that you are legally entitled to obtain from RSQ Australia.

8. Replacement products and parts

Where a replacement product or component is appropriate, availability may depend on current stock, manufacturer availability and whether the original product remains in production.

If an identical replacement is unavailable, we will discuss the available options with you.

We will not substitute a materially different product without your agreement where your agreement is required.

9. Circumstances that may not be covered

Subject to applicable law and the terms of any applicable manufacturer warranty, warranty coverage may not apply where a problem results from:

  • misuse, abuse or neglect;

  • accidental or external damage after supply;

  • incorrect installation;

  • installation contrary to supplied instructions;

  • unauthorised modification or repair;

  • use outside the product's specified ratings or intended application;

  • incorrect electrical supply, polarity, voltage or connection;

  • exposure to environmental conditions beyond the product's specified rating;

  • failure to perform required maintenance;

  • use of incompatible components or accessories; or

  • normal wear and tear.

Whether a particular issue is covered will depend on the circumstances, the product, any applicable manufacturer's warranty and applicable law.

10. Installation and vehicle applications

Some products supplied by RSQ Australia are intended for installation in vehicles, emergency vehicles, machinery or electrical systems.

Installation should be carried out by a suitably competent person and, where required, by an appropriately licensed or authorised person.

The installer is responsible for ensuring that installation is appropriate for the particular vehicle, equipment and application and complies with applicable requirements.

A product fault is different from a problem caused by incorrect installation or an incompatible application.

Nothing in this section limits a right you may have where RSQ Australia expressly recommended a product for a particular disclosed purpose and the applicable requirements for a consumer guarantee are satisfied.

11. Batteries and consumable products

Some products, including batteries and other consumable or service-life products, naturally deteriorate through use, age, operating conditions and charge or maintenance practices.

Normal deterioration or exhaustion through ordinary use is not necessarily a product defect.

Where a battery or similar product is the subject of a warranty claim, reasonable testing may be required to determine whether the issue results from a product fault, charging system, storage, application, use or normal deterioration.

Any applicable manufacturer warranty and your rights under Australian law continue to apply.

12. Proof of purchase

We may ask for reasonable proof that the product was purchased from RSQ Australia.

Acceptable evidence may include an:

  • order confirmation;

  • tax invoice;

  • receipt;

  • quotation or purchase order reference;

  • payment record; or

  • other record that reasonably demonstrates the purchase.

13. Warranty periods

Where a particular warranty period is advertised or provided for a product, that period relates to the applicable express or manufacturer's warranty.

Expiry of an express or manufacturer's warranty period does not necessarily mean that all rights under the Australian Consumer Law have ended.

Any rights available under the Australian Consumer Law depend on the circumstances and applicable law.
